Chicago IL – Short Sales are a situation that can often cause emotional turmoil as well as financial. It’s amazing how quick people are to judge others but times may be changing when it comes to today’s financial situations. We’re all feeling tough times. We all have seen local businesses close, people we know losing jobs they’ve had for years, and seen how the cost of living increases while the income we’re making doesn’t seem to be keeping the same pace.

Most of us don’t speak “legal-eze” and personally I’m thankful that most of us also don’t operate like some lenders. It’s hard to understand why a lender will jump at doing a Short Sale on a home as opposed to working with someone who’s done everything in their power to make right the situation they’ve ended up in, being overdue with the lender.

Many lenders somehow find it more logical to do a Short Sale than to work with the original owner and re-finance or negotiate terms that make it more reasonable for the owner to make regular payments again. Placing the overdue amounts at the end of your loan and putting you back on track seems more logical to you and I than taking a Short Sale. But then again, when does our logic seem to match the logic of most lenders?

What we have noticed though is that while we are all together in this financial mess of our economy we also seem to be more sympathetic and understanding about the situations of others. Friends and neighbors aren’t so quick to judge those who suddenly have a “Foreclosure” or “Short Sale” sign on their front lawn. People have become more sympathetic to those in their community who have been hit hard by hard times. There is no longer a scarlet letter worn by those who have hit hard times and find themselves having to give up their home via a Short Sale.

There is no shame in Short Sales. In most cases the home owners have approached their lender in every possible way, using every possible means to keep their home. Most lenders turn down every option other than literally snapping your fingers and coming up with all of the money owed instantly, no matter what the situation may be. These lenders should bear all of the shame for creating situations that don’t allow for a good, honest homeowner to maintain their dream.

A Short Sale is an option that is taken to help keep your dignity, sell your home, and have a fresh start. Many take this choice hoping to do less harm to their credit rating. Many times friends and neighbors will not only understand your situation but will respect that you’ve remained dignified through a terrible crisis in your life. Each of us understands that we are almost all only a paycheck away from being on the streets in today’s economy.

As we work together to make things better, one of the things we notice is that there truly is a lot less judging and finger pointing going on in life and a whole lot more understanding and help. The fingers are pointing to the lenders now instead.

“I am upside down by $300,000 on my home. I want to move, but I am concerned about having that $300,000 debt chasing me for the rest of my life. A friend mentioned I could get it wiped out in bankruptcy.

So, here is my question. Should I short sale and then declare bankruptcy. Or just declare bankruptcy and get rid of the house in the bankruptcy? James.”

Here was our answer to James’s Question. James, here is something you don’t know. In most short sales, the upside down debt will be erased.

Yes, the banks will forgive the upside down debt. We recently had a homeowner short sale a house where their bank lost over $400,000. They received a complete release on the debt.

The debt was gone and he had no need to declare bankruptcy. Not a bad deal, no? Here is the good news for you. First, many states have laws that forbid banks from pursuing you for a deficiency after a short sale or foreclosure.

Second, most lenders do not pursue borrowers. In fact, they will specifically release you from the debt. But, every situation is different.

There may be other possible options available in your area; including any governmental or non-profit organizations that may be able to help.

4.) Working with one realtor you can trust will not only establish a friend with useful information, but they will be there after the foreclosure when you’re going to need to know where to turn. They will have options available for you from rental units to get you through this tough spot, to possibly even purchasing a new home. You may be surprised at the options available. Having someone experienced in the business will be a plus no matter which direction you go once you finish the foreclosure process.

5.) Find a realtor in the Chicago area that truly cares. Yes, we are realtors to make money; it is our job. But we are also human beings and should remember to work with you while making you feel as good as possible with the options you may have. Perhaps this is a dark moment for you and your family but the truth is, if you have a good realtor you should have a good chance at finding a decent home, either as a rental or other possible ways of purchasing it. Chicago IL – What can you do if you are facing a foreclosure? One of the scariest and worse case scenarios for a homeowner is getting so far behind in your payments that foreclosure is leering around the corner. You feel as though you have let everyone, yourself included, down. You feel embarrassed, even if you aren’t actually holding the papers yet. So now what?

Here are a few tips to help you out:

1.) First off if you’ve been getting letters “threatening “ foreclosure you need to step up and take action. Ignoring them until you actually get the foreclosure papers sent to you will not make it go away.

2.) It’s time to sit down and figure out how far behind you are and if it is truly realistic to catch up your payments. You have to be real and honest with yourself about your situation and figure out a realistic budget to work with. Thinking that “oh I can do this, I just have to cut out my $5 latte every morning and make up the money” is not a realistic option that will get you out of the situation. Be realistic and figure out exactly how much you can budget each month for the necessities and the small extras. If you haven’t noticed, this entire step has used the word “realistic” and that’s the exact word you have to keep in mind.

3.) You have to realize and keep in mind that, in all honesty, the last thing your lender probably wants is to own your home. They are in the money business, not the home owning business. If they are forced to take over the home they’re also faced with everything a “homeowner” is faced with; such as all of the maintenance, upkeep, heating bills, air conditioning bills, all of the utility bills and more. This comes down to one thing, they really don’t want to take your home and would probably much rather work with you to make realistic arrangements in helping you keep your home.

4.) Do not avoid your lender. Call them and start to see what can be done to stop the foreclosure. Once the actual foreclosure begins it’s very hard to stop it; so you want to make sure you contact them immediately. If you reach a person that you simply cannot deal with and takes the approach of scare tactics and put downs, then immediately request to speak to their superior. You deserve to be treated with respect throughout the entire process and demand such.

Once you start talking to the financial agent you may find they have many options in place to help you. You are not the first person they’ve had who was in the position of possible foreclosure and you won’t be the last. Thinking about a short sale? This will help to reduce the short sale timeline. All of the documents will be submitted and if the negotiator needs anything else, they can request it earlier in the process.

Chicago IL – Short sales are difficult when you do not know what you are doing. But, they aren’t as difficult as people say.

Here are the three keys to getting a short sale approved.

#1: Follow up. Many agents don’t take short sales seriously. They have heard the horror stories from other agents and therefore don’t think their odds of success are very high.

Because of that, they don’t put much effort into the short sale. They’ll submit the short sale file, but won’t spend much time following up on it.

If it gets approved, then great. If not, then oh well. A denied or drawn out short sale just confirm their perception that short sales are difficult.

“I knew short sales were hard and this just confirms this”, they say to themselves. But, they never gave themselves a chance in the beginning and set themselves up for failure.

The key to getting our short sales approved is follow up. The bank’s negotiator is like a government bureaucrat. They don’t care if the short sale is approved or denied. They just process the file.

So you have to supply them with whatever they request. If you give them what they want, then with a little luck the short sale will be approved.

#2: Luck. Not every single short sale is going to be approved the first time. The bank won’t approve the short sale if they think it is selling below fair market value.

But, the bank’s valuation process is flawed. Sometimes the property will be valued fairly and sometimes it won’t. Sometimes luck is with you and the valuation is good.

Other times, it isn’t and the short sale is denies. Which brings us to Key #3: Time. If the short sale is denied, then you simply put the home back on the market and try again.

The odds are better than 50% of the time the valuation will be correct so the short sale can be approved. This gives you another fair shot at getting the short sale approved.

If luck is on your side, then the short sale is approved. If not, then you have to try again a third time. Again, the odds are in your favor.

If you have time on your side, then the odds will usually prevail and the short sale will be approved. That is why the vast majority of short sales are approved by the second time around. Most short sales are still owner occupied. As you probably know all bank foreclosure properties are vacant. An occupied property is much easier to sell than a vacant one.

An owner occupied home looks like a home. The furniture and appliances are setup in their proper places. The house is clean and kept up on.

So short sales do not always represent a bargain. They do represent a bargain compared to other homes on the market whose owners may not understand their home’s true value.

The bank will not approve a short sale unless the home is selling at or near it’s fair market value. So you get a fair price, but not necessarily a bargain when you buy a short sale. Chicago IL – The agent you hire to short sale your house should know how to “influence the BPO.”

The BPO is another agent’s opinion of the value of your home. The bank will willingly sell your home on a short sale if they think the home is selling for close to its fair market value.

The BPO is what they use to determine the fair market value. But, most agents that do BPOs do a lot of them. They may not spend a lot of time evaluating your home and the value.

Some of them turn in 100-200 valuations a month and not every one is accurate. That is why it is important that your agent make saure they understand what your home is worth.

They should meet the agent at your home and explain what the home is worth. That is called “influencing the BPO.”

An hour spent influencing a BPO will save countless hours later escalating a file or negotiating more offers. Yes, maybe I shouldn’t be saying this. But, it’s true.

Chicago IL – It is very helpful in loan modification negotiations to know the fair market value of your home. You can use the value to convince your lender to accept your loan modification offer.

As an experienced Short Sale Realtor, I can help you determine the value of your home. Here’s how I do that.

First, I will look at all of the homes similar to yours that have sold in the last 6 months. I will pick out the 3 homes that are most similar to yours.

Here are a few things that will cause me to pick one home versus another: Home has very similar features, number of bedrooms, and number of bathrooms. I also prefer to use bank owned and short sale properties.

Yes, it is true that bank owned properties usually sell for less than non bank owned homes. But, if your lender denies your loan modification or short sale and chooses to foreclose, then they will be selling the house as a bank owned property.

I might as well use the comparable sales closest to how they will be selling the property. After I pick out the 3 closest comparable sales, then I do a Comparable Market Analysis.

First, I make adjustments to the other sales. For example, if a home has 10% more living space, then I might adjust it’s comparable value by 5-8%.

After I make all the adjustments I average the sales price of the 3 similar homes. That gives me the fair market value of the home.

This process is very similar to what appraisers do, but it is not an appraisal. Rather, it is a Realtor’s Professional Opinion of your home’s value.

The professional terms for it is: Broker’s Price Opinion. The short version is BPO. Is it a good valuation of your home? Well, the banks think so.

Here is how you can avoid suffering under their incompetence. The key is to hold your bank accountable. Here’s how to do that.

ell them they can do as good of a job or as bad of a job as they want to on your short sale or loan modification. But, if they do not approve it, and lose money as a result, then you will report them.

Here is an example from an email we sent to a short sale negotiator. (Some of the details have been changed to protect the home seller’s identity.)

1. We have had the property at 193 NE Brock Lane for sale for over 4 months. Any buyer who would be interested in that house knows about it. They have decided not to make an offer.

The current offer is for $230,000. That is the highest and best offer we have received on this house. 2. I do not foresee a better offer coming in.

3. I project that if you reject this short sale and foreclose, then the home will sell for around $200,000. Here is how I came up with that number.

A. The local real estate market is declining by about 5% annually.

B. The foreclosure case is going very slow and will probably run for another 9-12 months.

C. Foreclosures sell for about 10% less than other listings.

4. The loan is owned by Fannie Mae. That means they and every American Taxpayer are the ones that stand to lose $30,000 or more. I will be contacting Fannie Mae, all of the members of congress, and my local newspaper.

I will let them know that you, John Doe, rejected this short sale and caused Uncle Sam to lose (another) $30,000.
